US Judge Mandates Release of Abrego Garcia from Immigration Detention
A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks legal authority.
"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case originates in a mistaken removal to El Salvador in March, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling charges, he was detained in federal custody.
In her decision, the court pointed out that the government does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
